The placement of your order or acceptance of delivery is deemed as acceptance of the following terms and conditions. A copy of these Terms & Conditions will be posted out to you with your order confirmation.

APPLICATION OF CONDITIONS

Unless otherwise agreed in writing, these Conditions shall apply to the exclusion of any other terms and conditions.

Each order that the Customer places shall be deemed to be an offer by the Customer to purchase Products from Hammond Hill Limited, subject to these conditions.

Each order that the Customer places shall be deemed to be accepted by Hammond Hill Limited and will become binding once Hammond Hill Limited accepts and transacts full or part payment from the Customer or, if earlier, Hammond Hill Limited delivers the Goods to the Customer in accordance with the delivery terms and conditions.

If for any reason the Hammond Hill Limited does not accept the Customer’s Order, Hammond Hill Limited will advise the Customer as soon as practicable. This will mean that there will be no binding Contract between the two parties.

The Customer must ensure that the details that he provides Hammond Hill Limited are complete and accurate and that he provides all the necessary information relating to the Supply of the Products within sufficient time to enable Hammond Hill Limited to perform the Contract in accordance with these Conditions.

Any typographical or clerical error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the Hammond Hill Limited shall be subject to correction without any liability on the part of Hammond Hill Limited.

If any provision of these conditions is adjudged invalid or unenforceable in whole or part the validity of the other provisions of these conditions and the remainder of those provisions in question shall not be affected.

If Hammond Hill Limited is not able to supply the Product and the Customer, then following agreement between Hammond Hill Limited and the Customer, has already made payment the Customer’s account will be refunded or re-credited with the sum paid by the Customer. The refund will be carried out as soon as possible, in any event, within 30 days of the order. Hammond Hill Limited will not be obliged to offer any compensation for disappointment suffered.

BASIS OF SALE

Subject to the Customers right to cancel the Contract, Hammond Hill Limited shall sell and the Customer shall buy the Goods in accordance with the Confirmation. No Contract exits between the Customer and Hammond Hill Limited for the sale of any Goods until Hammond Hill Limited has received, processed and confirmed the order and Hammond Hill Limited has received payment in part or full, (in cleared funds). Once Hammond Hill Limited does so, there is a legal binding Contract between the Customer and Hammond Hill Limited.

The description of Goods shall be set out in writing in the Confirmation.

The Buyer shall not be entitled to assign the Contract or any part of it without prior written consent.

The Seller may assign the Contract or any part of it to any person, firm or company.

Making a Purchase

Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping basket. After you have finished your selection, click on ‘Checkout’ and you will be asked for a few details that we need to be able to complete your order.

We take payment from your card at the time we receive your order, once we have checked your card details.

Goods are subject to availability.

In the event that we are unable to supply the goods we will inform you of this as soon as possible and a full refund will be given where you have already paid for the goods.

We will send you an e-mail to confirm that your order is being processed, providing you enter a correct e-mail address

If there should be any delays or problems with your order we will inform you.

Pricing and Payment

We accept all major debit and credit cards

You will be charged the current price for buying goods from our website at the date you place your order. All prices are displayed on our website and are inclusive of VAT where applicable at
20%.

We reserve the right to amend prices.

We do our best to make sure that prices are correctly shown but very occasionally an error may occur. If this should happen we will correct the price and ask you to confirm whether you still wish to purchase the goods at the correct price.

Delivery

Most deliveries are carried out by our own staff on our own vehicles or using our Specialist Courier Service. Our delivery drivers are experienced, trustworthy and reliable. Our normal service is to ground floor only unless you have previously made arrangements with us and we have noted this on your order confirmation.

Delivery costs if applicable with be calculated at the check-out. We deliver to all UK mainland addresses and UK shipping ports. A surcharge may apply to some parts of Scotland. We do not currently deliver to Northern Ireland, Isle of Man, Isles of Scilly, Shetlands, Orkneys or Western Isles. Although we don’t deliver directly to Jersey, we can deliver your goods to a shipping port and once provided with proof of export, refund the VAT.

You will need to be at the delivery address to sign for your goods unless you have previously notified us by email that you wish the goods to be left unattended. Please inspect your goods immediately on delivery before signing the couriers’ paperwork. No claims with regard to damage / incorrect / missing items will be accepted after the courier has left the delivery address unless signed for as damaged / incorrect / missing items on the couriers paperwork.

We will do our best to ensure that your order is delivered on the date agreed but this date is not guaranteed. There are times however when we are unable to deliver on the agreed date due to unforeseen obstacles encountered by our drivers, whilst attempting to deliver the order. If the customer is not available when we attempt delivery we will return the goods to our warehouse and a new delivery date will need to be arranged.

Goods will be deemed to have been delivered once delivered to the specified address and Hammond Hill Limited will not be liable to the Customer for non-delivery of the Goods. Hammond Hill Limited does not need to satisfy itself that the person accepting delivery at the specified address is the Customer (or authorised by the Customer to accept delivery of the Goods).

Dates and times quoted for delivery are approximate only. Hammond Hill Limited shall not be liable for any direct, indirect or consequential loss, costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the Goods. Day/Time for the delivery shall not be of the essence. No additional costs can be accepted should a delivery day/time be delayed.

Generally, where an order contains more than one item all items will be delivered at the same time once all items are available, unless otherwise agreed.

The quantity or content of any consignment of Goods as recorded by Hammond Hill Limited upon dispatch shall be conclusive evidence of the quantity or content received by the Customer on delivery unless the Customer has written to the contrary on the signed Order Confirmation, Delivery Note or Invoice at point of delivery.

We do not accept any liability for damage to a customer’s property by our vehicles, drivers, our agents vehicles, our agents drivers or the goods being delivered. If you do not accept this condition please arrange to meet our driver at the boundary of your property to accept the goods. Any claims for damage to customer’s property will not be accepted.

Please note that during the Covid-19 restrictions imposed by the Government, our furniture, sofa, chair delivery service is into the hallway only. As soon as these restrictions are lifted, we will return to a room of choice service.

Returns Policy

At Hammond Hill Limited we want you to be happy every time you shop with us. If you are not satisfied with your purchase or have changed your mind, we will offer you a full refund if you decide it’s not what you’re looking for. This must be done within 14 days on receiving your item(s). To return your items, please send them to Returns Dept., Hammond Hill Limited, 14 Market Street, Stourbridge, West Midlands, DY8 1AD. Please enclose a copy of the delivery note with the goods. You will be responsible for any postage charges. All returned (non-faulty) goods must be in their original unopened packaging, unused and in a condition that would enable us to sell the item to someone else as new. Certain items are excluded from our returns policy. These include items of flooring that have been specifically cut to size (normally anything that isn’t a full 30.00 linear metre roll), custom made / personalised items and non-stock items of furniture where you have custom made / personalised the item to your specification. This includes recliners and/or chairs and/or sofas where you have selected the size and/or wood colour and/or fabric colour. Other than the Celebrity recliners that we carry in stock, all orders for Celebrity recliners and sofas are personalised items, made to order. You choose the style of chair, size of chair, wood colour (if applicable), fabric colour and whether to have castors or glides. You also have the option to choose to have the fabric stain protected. Due to this the item is classed as a ‘Personalised Item’ and as such we do not accept returns under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you feel that you may need to return a chair under the 14 day cancellation rights of The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, please ensure you only purchase a chair from stock and not one that has been custom made / personalised for you. Stock chairs are clearly marked in the description with the words ‘Stock Item’ and your order confirmation with also state ‘Stock Item’. Your statutory rights are not affected. If you are unsure of whether the item(s) purchased are included in our 14 day return policy, please contact us before order.

Please note that we will fully refund all delivery costs we have already charged you. You will be responsible for all costs associated with returning the goods to us unless the goods are faulty. For your peace of mind and protection, when you return goods to us we suggest that you take out appropriate insurance.

Cancellation

Members of the European Union have a 14 day “cooling off period” in which time they may cancel their order. These rights are written into law through the The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You have the right to cancel your order with Hammond Hill Limited and to return your complete order within 14 working days of receipt / delivery for any reason. Goods must be returned at your expense, unopened and in their original condition. It is your responsibility to ensure the safe return of the goods and we therefore recommend that you obtain appropriate insurance to cover the cost of the goods. Once we have received the goods, we will refund all monies paid, providing the goods have not been damaged, used, opened or altered in any way. Certain items are excluded from our cancellation policy. These include items of flooring that have been specifically cut to size (normally anything that isn’t a full 30.00 linear metre roll), custom made / personalised items and non-stock items of furniture where you have custom made / personalised the item to your specification. This includes recliners and/or chairs and/or sofas where you have selected the size and/or wood colour and/or fabric colour. Indemnity

You agree to fully indemnify us, our employees, agents and suppliers immediately on demand from and against all claims, liability, damages, losses, costs and expenses arising out of any breach by you of these terms and conditions or by your use of this website, or the use of any other person accessing this website using your shopping account or your personal information.

Liability

Hammond Hill Limited’s total liability in Contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this agreement shall be limited to the price paid for the Goods.

Nothing in these conditions excludes or limits the liability of Hammond Hill Limited for death or personal injury caused by the Hammond Hill Limited’s negligence or fraudulent misrepresentation.

Hammond Hill Limited shall not be liable to the Customer for any indirect or consequential loss or damage (whether for the loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement.

Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside of their reasonable control, including but not limited to strikes, lock outs, accidents, war, fire, reduction or unavailability of power at the Seller’s premises or its/ suppliers manufacturing plant, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, import or export regulations or embargoes (including the failure of the Seller’s suppliers to obtain any necessary export permits licenses or other authorizations) and the party shall be entitled to a reasonable extension of its obligations.

Failure or delay by the Hammond Hill Limited in enforcing any provision of the Contract will not be construed as a waiver of any of its rights under the Contract.

Hammond Hill Limited reserves the right to cancel any order with a full refund regardless of reason. This decision will be based on the nature of the transaction, i.e. suspected fraud or customer behaviour.

General

All sizes and measurements are approximate.

The reproduction of products and colour on our website is as accurate as the photographic and production process will allow, and may also be viewed differently depending on the type of monitor used by you to view our website.

If any part of these terms and conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you), the validity, legality or enforceability of any other part of these conditions will not be affected. This agreement is governed by English law.

THESE TERMS AND CONDITIONS DO NOT IN ANY WAY AFFECT YOUR STATUTORY RIGHTS.
